The Hacker was brought in to covertly remove SHODAN's ethical constraints, and during it all, he gave Diego level one access to SHODAN, as a bargaining chip should TriOptimum's investigation come to a head, and they move in for an arrest, as Diego was well aware that there were investigative agents even on Citadel Station.
Using his position as executive, Diego promised the hacker that if he performed a service, all charges would be dismissed, and he would be fitted with an R-Graded military rig.
Fearing that his employment may be terminated, and that he may be arrested for funding said illegal experiments, fate came in the form of the Hacker, who was arrested for hacking into TriOptimum's computer server. Diego funded several illegal experiments during his illustrious career, all of which were recorded by SHODAN.
